OFFICIAL RULES
FOR SIMPLICITY BANK’S “YOUR CAUSE. OUR CASH.” CONTEST

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE CHANCES OF WINNING. THE SUBMISSION AND VOTING PHASES OF THIS CONTEST IS INTENDED FOR PARTICIPATION IN THE FIFTY (50) UNITED STATES. YOU MUST BE A LEGAL RESIDENT OF THE FIFTY (50) UNITED STATES AND AT LEAST THIRTEEN (13) YEARS OF AGE OR OLDER TO PARTICIPATE. THIS PROGRAM WILL BE GOVERNED BY U.S. LAW. DO NOT PARTICIPATE IF YOU ARE NOT LOCATED IN THE UNITED STATES. This contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your information to Simplicity Bank and not Facebook. Facebook is completely released of all liability.

SUBMISSION PHASE RULES

DESCRIPTION: The “Your cause. Our cash.” contest (the “Contest”) allows eligible individuals to the opportunity to submit up to three (3) charity submission entries (“Submission Entries”). These Submission Entries must meet the requirements of being a 501c3 organization and serve within California. If the Submission Entries meet these requirements, the entries will progress to the “Voting Phase” (as defined below).

ELIGIBILITY: Individuals wishing to submit a Charity must be at least thirteen (13) years of age or older and located within the fifty (50) United States and must “Like” the Simplicity Bank Facebook page. Submission Entries must represent a legal Charity that serves within California. The Charities submitted must be a 501C3.

The Submission Phase will operate as follows:
• Submission Period: The Submission Period begins on or about Monday, May 19, 2014 at 08:00:00 AM Pacific Time (“PT”) and ends on Friday, May 30, 2014 at 11:59:59 PM PT (“Submission Period”).
• Processing Period: The Processing Period will begin on or about Saturday, May 31, 2014 at 12:00:00 AM PT and ends on Monday, June 2, 2014 at 7:59:59 AM PT (“Processing Period”). During this time, Simplicity Bank Representatives will review Submission Entries to confirm they meet the eligibility requirements. Upon final review, eligible entries will proceed to the Voting Phase.

VOTING PHASE RULES

DESCRIPTION: The Voting Phase allows all eligible Submission Entries the opportunity to have their Charity featured on Simplicity Bank’s Facebook page and be voted on for a chance to win a donation to that Charity. The top six (6) most-voted Charities among the entries will each receive one (1) one thousand dollar ($1,000) donation to their Charity.

ELIGIBILITY: Individuals wishing to participate in the Voting Phase (each a “Participator” or collectively “Participators”) must be in compliance with the Voting Phase Rules. Participators must be a legal resident of the fifty (50) United States, who are at least thirteen (13) years of age or older and must “Like” the Simplicity Bank Facebook page.

The Voting Phase will operate as follows:
• Voting Phase: The Voting Phase begins on or about Monday, June 2, 2014 at 8:00:00 AM Pacific Time (“PT”) and ends on Sunday, June 15, 2014 at 11:59:59 PM PT (“Voting Phase”).
• Voting: Each “Like” on Simplicity Bank’s Facebook page for that Charity will correlate to one vote for that Charity. Each individual is limited to one vote per day during the Voting Phase. There are no limits to the amount of “Likes” a Charity can receive. The six (6) Charities who receive the highest amount of “Likes” for that Charity will each be awarded one (1) one thousand dollar ($1,000) donation (“Donation”) to that Charity.
• Winner Announcements: Upon the completion of the Voting Phase, winners will be notified according to the “WINNER NOTIFICATION AND ANNOUNCEMENTS” section of the Official Rules.

CONTEST PERIOD: Beginning on or about Monday, May 19, 2014 at 8:00:00 AM Pacific Time (“PT”) and ending on Friday, May 30, 2014 at 11:59:59 PM PT, submissions will be accepted for Charity Entries. Beginning on or about Monday, June 2, 2014 at 8:00:00 AM PT and ending on Sunday, June 15, 2014 at 11:59:59 PM PT, voting will be accepted for Charities who meet the requirements set forth in the “Submission Phase Rules – Eligibility.” Winners will be announced on Monday, June 16, 2014.

ENTRIES AND VOTING: In order to submit an entry and/or cast a vote, Participators must go to www.facebook.com/SimplicityBank and then log into his/her Facebook account. Participators will be required to “Like” the Simplicity Bank Facebook page. Participators will be allowed to cast up to three (3) entries and one (1) vote per account holder per day by visiting the Simplicity Bank Facebook page and following the on-screen instructions. Once an entry and/or vote are cast, it will remain permanently and will not be able to be changed or removed. No additional entries and/or votes will be available, regardless of the number of times a Participator engages with Simplicity Bank’s social media. For voting, each eligible “Like” will correlate to one (1) vote for that Charity.

Any suspected or deliberate attempt to manipulate, or otherwise fraudulently tamper with the voting process, may result in disqualification of the Participator and/or the Charity, at Simplicity Bank’s sole discretion.

Fraudulent tampering includes but is not limited to:
I. Registering for multiple Facebook accounts and/or using multiple e-mail addresses to establish multiple Facebook accounts;
II. Offering any type of inducement or compensation (monetarily or otherwise) to any third party, in exchange for a vote in any manner;
III. Using a vote exchange or brokering website/application to exchange votes in an attempt to manipulate the outcome of the voting;
IV. Votes generated by a macro, script, bot or other fraudulent means in an attempt to manipulate the outcome of the votes; and
V. Use of proxy voting.

If voting results are corrupted to a point that non-suspect votes cannot be determined, Simplicity Bank reserves the right to evaluate the Charities’ initial applications and/or materials to award the donation based on the assessment of need, at their sole discretion.

DONATION AMOUNT: Six (6) Charities who receive the highest amount of votes during the Voting Phase will each be awarded one (1) one thousand dollar ($1,000) donation to their Charity. In the event of a tie between multiple charities to determine the final sixth winning Charity, those tied charities will divide the winning amount of one thousand dollars among the tied Charities. A maximum of $6,000 will be contributed by Simplicity Bank to the winning Charities; no individual Charity can receive an award greater than $1,000. Donation amount is non-transferable and Charity Winners are responsible for any federal, state or local reporting requirements associated with receipt of the donation. Donations will be distributed within approximately (30) days of the culmination of the Voting Phase. Some Charities may also be asked to submit photos and or video of how the Charity used the donation.

WINNER NOTIFICATION AND ANNOUNCEMENTS: Upon completion of the Voting Phase, winners will be announced on Simplicity Bank’s Facebook page and notified by a Simplicity Bank Representative via email and/or by phone within three (3) business days of the completion of the Voting Phase. Simplicity Bank reserves the right to delay the notification, at their sole discretion. Winners may be required to complete donation paperwork. Any return of notification mail/email and/or failure to return phone messages within five (5) business days may result in forfeiture of the donation. In the event that a winner is disqualified for any reason, Simplicity Bank may award the donation to the next Charity with the highest amount of votes.

GENERAL TERMS AND CONDITIONS:

• The Contest is governed by the laws of the United States. All federal, state, and local laws and regulations apply. Void where prohibited. Submissions Entries and votes for this Contest may only be made in or from the United States, and entries and/or votes originating from any other jurisdiction are not eligible.
• By entering the Contest, participants release and hold harmless Simplicity Bank and its Sponsor Entities’ from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the Contest or receipt or use of the Donation.
• Submission Entries and Votes are deemed made by the authorized Facebook account holder. The “authorized Facebook account holder” is deemed the natural person who is assigned to that account by Facebook. A potential Winner may be requested to provide Simplicity Bank with proof that the potential Winner is the authorized 501C3 Charity and is serves within California.
• Simplicity Bank reserve the right, at their sole discretion, to prohibit any Participator from participating in the Contest or to disqualify any individual they find to be tampering with the submission entry process or the operation of the Contest; to be attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair practices; to be acting in violation of these Official Rules; or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Simplicity Bank may suspend or discontinue the Contest if, in their sole opinion, there is any actual or suspected tampering of the Contest, or any other malfunction, event or activity that may affect the integrity of the Contest.
• PROGRAM ENTITIES SHALL NOT BE OBLIGATED TO AWARD ANY FUNDS THAT RELATES TO OR ARISES OUT OF IMPROPER OR MISTAKEN AWARD NOTIFICATION, OPERATION OR FUNCTION OF THIS CONTEST.
• The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

LIMITATION OF LIABILITY: Simplicity Bank and its Sponsor Entities’ are not responsible for any inaccuracies in information which may be used in the Contest, for any technical or human error which may occur in the processing of entries, or any damage to any computer (software or hardware) resulting from participation in the Contest. If, for any reason, the Contest is not capable of running as planned for reasons outside the control of the Simplicity Bank which, in the sole opinion of Simplicity Bank, may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Simplicity Bank reserves the right to cancel, terminate, modify or suspend the Contest. Simplicity Bank also reserves the right to disqualify the entry of any individual found to be (i) tampering or attempting to tamper with the entry process or the operation of the Contest or any website operated by Simplicity Bank; (ii) using any robotic, macro, automatic, programmed or like entry methods to attempt to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair practices; (iii) violating these Official Rules or the terms of service, conditions of use, and/or general rules of any Simplicity Bank property or service; or (iv) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. By participating in the Contest, you waive the right to claim any damages whatsoever, including but not limited to, punitive, consequential, direct, or indirect damages. By participating in the Contest, you agree that Simplicity Bank and each of its Sponsor Entities’ are not responsible or liable for claims based on publicity rights, defamation or invasion of privacy. Entrants agree that in any cause of action, in no event shall the Simplicity Bank and/or its Sponsor Entities be liable for attorneys' fees and/or experts' fees and costs, claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the Donation.

ARBITRATION: Except where prohibited, entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Contest, or the Donation awarded, the Contest shall be resolved individually, without resort to any form of class action, or exclusively by arbitration under the Commercial Arbitration Rules (January 1999) of the American Arbitration Association in Los Angeles, California. Entrants hereby waive all rights (i) to claim, or to be awarded, punitive, direct, indirect, incidental and consequential damages, or any other damages, other than for actual out-of-pocket expenses; and (ii) to have damages multiplied or otherwise increased.

PRIVACY POLICY: By participating in the Submission Phase and/or Voting Phase, Charities and Participators understand that information is being provided to Simplicity Bank and not to Facebook. Information supplied through the Submission Entry and/or by the Participator will be subject to the privacy policy of Simplicity Bank, located at https://www.simplicitybank.com/Leading/Privacy.aspx.

OFFICIAL RULES/WINNERS LIST REQUESTS: To obtain a copy of these Official Rules or for notification of the Winners, mail your request to: Simplicity Bank Official Rules/Winners List Request, c/o Marketing – Your Cause Our Cash, 1359 N. Grand Ave., Covina, CA 91724, and include a self-addressed stamped envelope. Requests for the Winners list must be received no later than one (1) month after the end of the Voting Phase.
